Validity of the terms and conditions

These general terms and conditions apply to all products, deliveries and services listed on the homepage of Herfa. General terms and conditions of the customer are expressly not part of the contract, even if they are not expressly contradicted by Herfa. In the event that the customer does not want to accept the following general terms and conditions, he must first notify Herfa in writing. Our terms and conditions apply to shipping within the Federal Republic of Germany. Deliveries abroad are only possible after an arrangement.

  1. Conclusion of the contract

Our Internet offer is not an offer in the legal sense, but an invitation to the offer. The purchase contract is concluded when we accept your order (offer) by delivery of the goods or by the notification of delivery or by any other explanation. The customer receives an acknowledgment of receipt from Herfa by e-mail, in which the right of revocation is also informed. This confirmation of receipt is not yet an acceptance of the offer. Herfa is not obliged to accept the customer's order. If Herfa does not execute an online order, Herfa will inform the customer.

The contract text will not be stored by us and can not be retrieved after the completion of the order process. The customer can print the data after immediately after the sending of the order.

  1. Delivery / shipping costs

The terms of delivery specified at the time of ordering apply. The delivery times are product dependent. Usually, however, the purchased goods leave Herfa within 5 working days. For larger orders and small series in particular, the delivery time depends on the individual case. In this case, the customer receives notification of the delivery time. These dates and deadlines are estimated delivery times or regular delivery times while stocks last.

If delivery delays occur after an order, or the ordered product is no longer available, because we are not supplied with this product by our suppliers without own fault, we can withdraw from the contract. In this case, the customer will be informed immediately and possibly suggest the delivery of a comparable product. If no comparable product is available or the customer does not wish to receive a comparable product, we will immediately refund any compensation already paid.

Delivery delays due to events that make the delivery considerably more difficult or impossible for the manufacturer, are not the responsability of the seller. In case of impossibility of the delivery, we are entitled to withdraw from the contract. From this, the customer can not derive any claims for damages.

If you select the payment method in advance or bank transfer, the shipping starts only after the receipt of the customer payment.

  1. Prices and payment methods

The prices stated at the time of ordering apply.

Herfa reserves the right to exclude certain payment methods, following the outcome of a credit check.

In case of a previous return of delivery parts, the invoice amount can be reduced accordingly.

If the customer is in default of payment, Herfa reserves the right to charge dunning fees of 4.00 Euro. In the case of default of payment, the customer commits moreover to the replacement of all costs, expenses and out-of-pocket expenses incurred by Herfa through appropriate pursuit of the claims. The costs of debt recovery include, without prejudice to a procedural cost compensation, all extrajudicial (rate standard ) costs of a licensed collection agency and a lawyer.

The goods remain the property of Herfa until full payment.

  1. Privacy & Creditors Protection

Detailed information on encryption and data protection can be found under the Privacy Policy (see there). Of course, all personal data will be treated strictly confidentially and your legitimate concerns will be strictly taken into account in accordance with the legal requirements.

In addition to the purposes described above, we use the data provided to us for our own advertising purposes, if you have subscribed to our free newsletter. You may at any time object to the further use of your data for this purpose by simply notifying Herfa (contact: hello@herfa.eu).

  1. Right of withdrawal and return

You will be informed about a possible right of revocation with the cancellation policy which is enclosed in each order and with the retrievable cancellation policy (see there), that you can read on our homepage. Before accepting the purchase offer, we will send you the cancellation policy by e-mail. In the case of a cancellation, the customer has to bear the costs of the return, if the delivered goods correspond to those ordered and if the price of the goods to be returned does not exceed 40 euros, or if the customer still has at the time of cancellation at a higher price, not provided the compensation or a contractually agreed part payment.

  1. Warranty and miscellaneous

Unless agreed otherwise, the statutory warranty provisions apply.

An offsetting against the purchase price claim is only possible for the customer with a recognized or legally established counterclaim.

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, this shall not affect the validity of the remaining provisions.

On the contrary, what comes next in the place of the invalid provisions comes closest to the intended purpose. Additional agreements are not made.

Contractual supplements will only be effective, if confirmed in writing.Jurisdiction is, as far as legally permissible, ie the customer is not a consumer, the seat of Herfa in Stuttgart, Germany.
